1 Acceptance of Terms

Welcome to Momo. These Terms of Service ("Terms") govern your access to and use of the Momo mobile application ("the App") and any related services (collectively, the "Service"), operated by Momo ("we", "us", or "our").

By downloading, installing, or using Momo, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

If you are under 13 years of age (or 16 in the European Economic Area), you may not use the Service. By using Momo, you represent that you meet the applicable age requirement.

2 Description of Service

Momo is a mobile nutrition tracking application that uses artificial intelligence to analyse meal photos and provide users with a Balance Score based on the Harvard Healthy Eating Plate framework. The Service includes:

• AI-powered meal photo analysis that identifies food groups
• A daily Balance Score (0–100) reflecting the nutritional quality of your meals
• Personalised coaching insights (available on Momo Premium)
• Progress tracking, streaks, achievements, and gamification features
• An animated Momo character that evolves with your engagement

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3 Health Disclaimer

The Balance Score and nutritional guidance provided by Momo are based on general wellness principles (the Harvard Healthy Eating Plate) and are intended as educational information only. They are not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.

You should:

• Always seek the advice of your physician, dietitian, or other qualified health provider with any questions about your diet or health
• Never disregard professional medical advice or delay seeking it because of something you have read or seen in Momo
• Consult a healthcare professional before making significant changes to your diet, especially if you have a medical condition, eating disorder, or are pregnant or breastfeeding

Momo does not make any warranties or representations regarding the accuracy, completeness, or suitability of nutritional information for any individual's specific health needs.

4 Subscriptions & Payments

Free Plan: Momo offers a free tier that allows you to log up to 3 meals per day and access core features at no charge.

Momo Premium: Additional features, including unlimited meal scans and personalised AI coaching, are available through a paid monthly subscription ("Momo Premium").

• Pricing: The current price is £4.99 per month (or the equivalent in your local currency). Pricing may vary by region and is subject to change.
• Free Trial: A 7-day free trial may be offered to eligible new subscribers. You will not be charged during the trial period.
• Billing: Subscriptions are billed through the Apple App Store. Your iTunes Account will be charged at confirmation of purchase and upon each renewal.
• Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refunds are subject to Apple's App Store refund policy. We do not issue refunds directly.
• Restore Purchases: If you have an active subscription and it is not reflected in the app, you may use the "Restore Purchases" feature in the Account settings.

5 User Responsibilities

By using Momo, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Provide accurate information when using features that require input
• Keep any account credentials (if applicable) confidential and secure
• Notify us immediately of any unauthorised access to your account
• Not attempt to reverse engineer, decompile, or disassemble the app
• Not use the Service in any way that could damage, disable, or impair the servers or networks connected to Momo
• Not use automated tools, bots, or scripts to access or interact with the Service
• Not attempt to circumvent any usage limits, including the free plan meal scan limits
• Not use the Service for any commercial purpose without our prior written consent

We reserve the right to suspend or terminate your access to the Service if you violate these responsibilities.

6 Intellectual Property

All content, features, and functionality of Momo — including but not limited to the Momo character design, the Balance Score system, the app interface, graphics, text, animations, and the underlying software — are the exclusive property of Momo and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your personal, non-commercial use, subject to these Terms.

You may not:

• Copy, modify, or distribute any content from the Service
• Use the Momo name, logo, or character in any commercial context
• Create derivative works based on the Service
• Claim ownership of any content generated by Momo

Meal photos you take remain your property. By submitting photos for analysis, you grant us a limited licence to process them solely for the purpose of providing the meal analysis feature.

7 Privacy

Your privacy matters deeply to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

8 Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The AI meal analysis will be perfectly accurate for every meal in every situation
• The results of using the Service will meet your specific health or nutrition goals
• Any errors in the Service will be corrected

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £10 if you have not made any payments.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.

9 Termination

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or engage in any conduct that we reasonably determine to be harmful to the Service or other users.

You may stop using the Service at any time. If you have a Momo Premium subscription, cancellation is managed through your Apple ID settings.

Upon termination:

• Your right to access the Service will immediately cease
• Any locally stored data on your device will remain until you delete the app
• Any account data (if applicable) may be deleted after a reasonable retention period

Sections 3 (Health Disclaimer), 6 (Intellectual Property), 8 (Disclaimers), and 11 (Governing Law) shall survive termination.

10 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify you through a notice in the Momo app or, where required, via email
• Where required by law, seek your consent before implementing the changes

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection laws in your country give you the right to bring proceedings in your local courts.

If you are a consumer in the EU, you also have the right to use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
